I request your approval of a grant by private treaty of 13,000 sq. ft. of land lying between Austin and Kimberley Roada, Kowloon, to the Canossian Institute on the following conditions:-

(1) The land to be granted as an extension of Kowloon Inland Lot 617 which is immediately adjacent to the land in question and forms part of St. Mary's School: the grantees being required to surrender the lease of this lot and accept a new Crown lease covering it and the present extension,

(2) Iease term 75 years from the 25th December, 1889, to

accord with the unexpired term of the lot referred to above. (3) Premium, nil

(4) Normal Crown rent of the area at the rate of $5,000.00 per

acre, amounting to about 1,492,00 per annum.

(5) Building Covenant of $1,200,000 to be completed within 36 months on new school buildings to be erected partly on adjacent land already held by the School, and partly on the extension area.

(6) User to be restricted to the purposes of a non-profit-

making school.

(7) Prohibition against sale, letting, charge, mortgage or assignment without the previous consent of Government, (8) Provision for surrender without compensation of any part

of the land required for a public purpose.

(9) Reversion to the Crown without compensation in the event

of any breach of the conditions of grant,

The land in question formed the northern end of a branch of Kimberley Road which has recently been closed under the Streets (Alteration) Ordinance No. 24 of 1923 and is flanked on either side by lots owned by the Canossian Institute on which St, Marv's School stands. The School provides education for over 1500 muni's and is now so overcrowded that children will have to be turned away if further accommodation is not provided, There is little room within the existing properties of the School for this very necessary expansion without overcrowding the buildings to a degree which is unacceptable, nor is there any other vacant land in the vicinity, The closure of this section of Kimberler Road will cause no hardship as the road is joined to Austin Road by another branch only about one hundred yards away. No objections were raised when the intention to close the road was published,
